Police Superannuation Pension Scheme
Change in Legislation - Spouse Benefit
nder changes to the Police Superannuation Act the following persons are entitled to a spouse benefit in the event of a death of a serving or retired member of the Police Superannuation Pension Scheme.
Lawful Spouse
The deceased members lawful spouse if
- he or she became the members lawful spouse before the termination of the members employment; or
- he or she was the members lawful spouse for a period of five years immediately preceding the members death.
Lawful Spouse/Husband or Wife De Facto
A person who was cohabiting with the member at the time of death as the lawful spouse or the husband or wife de facto of the member:.
(i) if he or she had cohabited with the member either as the lawful spouse or the husband or wife de facto of the member (or in both of those capacities at different times):
- continuously for the period of five years immediately preceding the members death; or
- during the period of six years immediately preceding the members death for periods aggregating not less than five years; or
(ii) if he or she is the natural parent of a child of whom the member was the other natural parent.
In cases where a person makes a claim as the husband or wife de facto of a deceased member the person will be required to provide evidence of the relationship by way a statutory declaration to the Police Superannuation Board which will determine the claim.
